1. Acceptance of Terms

By creating an account, downloading, installing, accessing, or using NoteNest in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference.

1.2 Eligibility

You must be at least 13 years of age to use NoteNest. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use NoteNest under the supervision of a parent or legal guardian who agrees to these Terms. By using NoteNest, you represent and warrant that you meet these eligibility requirements.

1.3 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

• Updating the "Last Updated" date at the top of this page
• Sending an in-app notification or email to registered users
• Posting a notice on our website

Your continued use of NoteNest after any changes to these Terms constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the App and may delete your account.

2. Description of Service

2.1 NoteNest Features

NoteNest is a comprehensive productivity application for Android devices that provides users with tools to:

• Create, edit, organize, and delete notes
• Manage to-do lists and wish lists
• Set and receive reminders with local notifications
• Categorize and tag content for organization
• Search and filter notes and tasks
• Export notes in multiple formats (PDF, text, image)
• Use home screen widgets for quick access
• Create local and cloud backups (Google Drive)
• Switch between light and dark themes
• Customize app settings and preferences

2.2 Service Availability

We strive to maintain high availability of NoteNest, but we do not guarantee that the App will be available at all times or without interruption. The App may be temporarily unavailable due to:

• Scheduled maintenance or updates
• Technical issues or server problems
• Circumstances beyond our reasonable control

We reserve the right to modify, suspend, or discontinue any feature or aspect of NoteNest at any time without prior notice.

2.3 Updates and Modifications

We may release updates, patches, or new versions of NoteNest from time to time. These updates may be necessary for security, bug fixes, new features, or compatibility. You agree to download and install updates as they become available. Some features may require the latest version of the App to function properly.

3. User Accounts and Registration

3.1 Account Creation

To use certain features of NoteNest, you must create an account by providing:

• A valid email address
• A secure password meeting our requirements (minimum 8 characters, including uppercase, lowercase, number, and special character)
• A username (subject to availability and our guidelines)

Alternatively, you may create an account using Google Sign-In, subject to Google's terms and policies.

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Ensuring your account information is accurate and up-to-date

We implement industry-standard security measures, including encrypted storage and Firebase Authentication, but cannot guarantee absolute security. You agree not to share your account credentials with others.

3.3 Account Termination

You may delete your account at any time through our Account Deletion page or by contacting us at saihemanth225@gmail.com. Upon deletion:

• Your account data will be permanently deleted within 30 days
• Local data on your device will be immediately removed
• Cloud backups in your Google Drive remain under your control
• This action is irreversible and cannot be undone

4. User Content and Data

4.1 Ownership of Your Content

You retain all ownership rights to the content you create, store, or manage in NoteNest, including:

• Notes, reminders, and task descriptions
• Categories, tags, and organizational structures
• Any files, images, or media you upload or create
• Exported content in any format

4.2 License to Use Your Content

By using NoteNest, you grant us a limited, non-exclusive, royalty-free license to:

• Store your content on your device using encrypted local storage
• Process your content to provide App functionality (search, categorization, reminders)
• Back up your content to Google Drive (only if you explicitly enable cloud backup)
• Transmit your content as necessary to provide Services (e.g., Firebase Authentication)

Important: We do NOT access, read, analyze, or use your note content for any purpose other than providing the Service. Your notes remain private and are stored locally on your device using encrypted storage.

4.3 Data Storage and Security

NoteNest uses a "local-first" approach:

• Local Storage: All your data is stored locally on your Android device using encrypted Room Database and EncryptedSharedPreferences
• Cloud Backup (Optional): You may choose to back up your encrypted database to your personal Google Drive. We do not have access to your Google Drive data
• Firebase Services: We use Firebase Authentication for secure login, Firebase Crashlytics for crash reporting, and Firebase Analytics for aggregated usage statistics (no personal content is shared)

4.4 Backup Responsibility

While NoteNest provides local and cloud backup features, you are solely responsible for maintaining backups of your important data. We are not liable for any data loss, corruption, or deletion that may occur due to:

• Device malfunction, loss, or theft
• App uninstallation or data clearing
• Operating system updates or factory resets
• User error or accidental deletion
• Technical failures beyond our control

We strongly recommend regularly creating backups using our backup features.

5. Acceptable Use Policy

5.1 Permitted Use

NoteNest is intended for personal, non-commercial productivity purposes. You may use the App to:

• Organize personal notes, tasks, and reminders
• Manage work-related or educational content
• Track personal goals and wish lists
• Share exported content with others as needed

5.2 Prohibited Activities

You agree NOT to use NoteNest to:

• Violate Laws: Engage in any illegal activities or violate any applicable laws or regulations
• Infringe Rights: Violate intellectual property rights, privacy rights, or other rights of third parties
• Harmful Content: Store, create, or share content that is harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Malicious Use: Upload or distribute viruses, malware, or any harmful code
• Reverse Engineer: Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Circumvent Security: Attempt to bypass, disable, or interfere with security features or access restrictions
• Unauthorized Access: Access or attempt to access other users' accounts or data
• Commercial Exploitation: Resell, redistribute, or commercially exploit the App without authorization
• Automated Access: Use bots, scripts, or automated tools to access the App
• Resource Abuse: Overload or interfere with our servers or infrastructure

5.3 Content Moderation

While we do not actively monitor user content stored locally on devices, we reserve the right to investigate reports of Terms violations and take appropriate action, including account suspension or termination.

6. Intellectual Property Rights

6.1 Our Intellectual Property

NoteNest and all related technology, software, designs, graphics, logos, trademarks, and other materials are owned by Thogoruchesti Hemanth and are protected by copyright, trademark, and other intellectual property laws. This includes:

• The NoteNest app code, design, and architecture
• The NoteNest name, logo, and branding
• User interface designs and visual elements
• Documentation and support materials

You may not copy, modify, distribute, sell, or create derivative works based on NoteNest without our explicit written permission.

6.2 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install NoteNest on your personal Android devices
• Use the App for personal productivity purposes
• Access and use features as intended

This license does not include any rights to:

• Resell, redistribute, or sublicense the App
• Modify, adapt, or create derivative works
• Use the App for commercial purposes without authorization

6.3 Third-Party Services

NoteNest integrates with third-party services (Firebase, Google Drive) that are subject to their own terms and conditions. Your use of these services is governed by their respective terms:

7. Premium Features and Payments

7.1 Free Version

NoteNest is currently offered free of charge with all core features available to all users, including notes, reminders, to-do lists, categories, widgets, local backups, and export functionality.

7.2 Future Premium Features

We may introduce premium features in the future that require payment or subscription. If and when premium features are introduced:

• We will provide clear notice and pricing information
• All current free features will remain free
• Premium features may include enhanced storage limits, advanced cloud sync, collaboration tools, and priority support
• Payments will be processed through Google Play billing
• Separate terms may apply to premium subscriptions

7.3 Usage Limits

We may implement usage limits using Firebase Remote Config to ensure fair use and system stability. These limits may include:

• Maximum number of notes, reminders, or categories (for free tier)
• Storage size limitations
• API rate limiting

Users will be notified of any applicable limits within the App.

8. Disclaimers and Limitations of Liability

8.1 "As-Is" Disclaimer

NoteNest is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of any content
• Warranties that defects will be corrected

We do not warrant that NoteNest will meet your requirements or expectations.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THOGORUCHESTI HEMANTH AND NOTESNEST SHALL NOT BE LIABLE FOR ANY:

• Indirect, Incidental, Special, Consequential, or Punitive Damages
• Loss of Profits, Revenue, Data, or Use
• Loss of or Damage to Data or Content
• Business Interruption
• Personal Injury or Property Damage

This applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

8.3 Maximum Liability

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the maximum extent permitted by law. In no event shall our total liability to you exceed the amount you paid to us (if any) in the twelve (12) months preceding the event giving rise to liability.

8.4 Device and Data Responsibility

You are solely responsible for:

• Your device's functionality, security, and maintenance
• Internet connectivity and data charges
• Backing up your data regularly
• Any consequences of device loss, theft, or malfunction

9. Indemnification

You agree to indemnify, defend, and hold harmless Thogoruchesti Hemanth, NoteNest, and our affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of NoteNest
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations
• Any content you create, store, or share using the App

10. Termination and Suspension

10.1 Termination by You

You may terminate your use of NoteNest at any time by:

• Deleting your account through the Account Deletion page
• Uninstalling the App from your device
• Contacting us at saihemanth225@gmail.com

10.2 Termination by Us

We reserve the right to suspend or terminate your access to NoteNest immediately, without prior notice or liability, for any reason, including:

• Violation of these Terms
• Suspected fraudulent, abusive, or illegal activity
• Extended periods of inactivity (3+ years)
• At our sole discretion for any other reason

10.3 Effect of Termination

Upon termination:

• Your right to use NoteNest immediately ceases
• Your account and data may be deleted
• Provisions that should survive termination will remain in effect (e.g., ownership, disclaimers, limitations of liability)
• You remain responsible for any obligations incurred before termination

11. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using NoteNest, you consent to our privacy practices as described in the Privacy Policy.

Key Privacy Points:

• Local-first data storage with encrypted databases
• No access to your note content by developers
• Optional cloud backup to your personal Google Drive
• Firebase services for authentication, crash reporting, and analytics
• No selling or sharing of personal data with third parties
• Compliance with GDPR, CCPA, and other privacy regulations

12. Third-Party Links and Services

NoteNest may contain links to third-party websites, services, or resources. These are provided for your convenience only. We do not:

• Endorse or assume responsibility for third-party content
• Control or monitor third-party services
• Guarantee the accuracy or reliability of third-party information

Your use of third-party services is at your own risk and subject to their terms and privacy policies.

13. Export Controls and Compliance

You agree to comply with all applicable export and import laws and regulations. You represent that you are not:

• Located in a country subject to a U.S. government embargo
• Listed on any U.S. government list of prohibited or restricted parties
• Subject to any other applicable trade restrictions

14. Dispute Resolution and Governing Law

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. The developer is based in Haryana, India.

14.2 Jurisdiction

Any disputes arising from these Terms or your use of NoteNest shall be subject to the exclusive jurisdiction of the courts located in Haryana, India.

14.3 Informal Resolution

Before initiating formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at saihemanth225@gmail.com. We will make reasonable efforts to resolve disputes amicably.

15. Miscellaneous Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Thogoruchesti Hemanth regarding NoteNest and supersede all prior agreements and understandings.

15.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by us.

15.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

15.5 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.

15.6 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, pandemics, government actions, or technical failures.

15.7 Language

These Terms are written in English. Any translations are provided for convenience only. In case of conflicts, the English version prevails.

16. Google Play Policies

Your use of NoteNest downloaded from Google Play Store is also subject to:

• Google Play Terms of Service: https://play.google.com/intl/en_us/about/play-terms/
• Google Play Developer Distribution Agreement
• Android SDK License Agreement

In case of conflict between these Terms and Google Play policies, Google Play policies shall prevail with respect to your use of the Google Play Store.

17. Feedback and Suggestions

We welcome your feedback, suggestions, and ideas for improving NoteNest. By submitting feedback through our Feedback page, email, or other channels, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate your feedback into NoteNest without any obligation to you.

BY DOWNLOADING, INSTALLING, OR USING NOTESNEST, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE NOTESNEST.
