By accessing or using the NotesNest platform, websites, or services (collectively, the "Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these terms.

Important Notice

If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

1.2 Eligibility

You must be at least 13 years of age to use NotesNest. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use NotesNest under the supervision of a parent or legal guardian who agrees to these Terms. By using NotesNest, you represent and warrant that you meet these eligibility requirements.

1.3 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

Updating the "Last Updated" date at the top of this page
Sending an in-app notification or email to registered users
Posting a notice on our website

Your continued use of NotesNest after any changes to these Terms constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the App and may delete your account.

2. User Accounts & Responsibilities

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process.

Account Security

You are responsible for safeguarding your password and any activities under your account.

Unauthorized Use

Notify NotesNest immediately of any unauthorized use or security breach.

Termination

We reserve the right to suspend or terminate accounts that violate these terms.

Age Requirement

Users must be at least 13 years of age (or 16 in certain jurisdictions).

2.1 Description of NotesNest Features

NotesNest is a comprehensive productivity application for Android devices that provides users with tools to create, edit, organize, and delete notes, manage tasks, wish lists, set reminders, cloud backups, customize layouts, and export notes in multiple formats.

We reserve the right to modify, suspend, or discontinue any feature or aspect of NotesNest at any time without prior notice.

2.2 Account Creation

To use certain features of NotesNest, you must create an account by providing a valid email address and a secure password. Alternatively, you may create an account using Google Sign-In, subject to Google's terms and policies.

2.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials, all activities that occur under your account, and notifying us immediately of any unauthorized access or security breach.

2.4 Account Termination

You may delete your account at any time through our Account Deletion page or by contacting us at saihemanth225@gmail.com. Upon deletion, your account data will be permanently deleted within 30 days.

3. Content & Data Ownership

"User Content" means any text, graphics, photos, or other materials uploaded or stored by users on the Service. You retain full ownership of your content.

What You Keep

Your intellectual property remains yours. We do not claim ownership of any content you create or upload.

What We Need

A limited license to host, store, and display your content to provide the service as intended.

3.1 Ownership of Your Content

You retain all ownership rights to the content you create, store, or manage in NotesNest, including notes, reminders, task descriptions, tags, files, images, and exported content in any format.

3.2 License to Use Your Content

By using NotesNest, you grant us a limited, non-exclusive, royalty-free license to store your content on your device using encrypted local storage, process your content to provide App functionality, back up your content to Google Drive (if enabled), and transmit your content as necessary to provide Services.

Important: We do NOT access, read, analyze, or use your note content for any purpose other than providing the Service.

3.3 Data Storage and Security

NotesNest uses a "local-first" approach. All your data is stored locally on your Android device using encrypted Room Database and EncryptedSharedPreferences. Cloud backup is optional and securely backed up to your personal Google Drive.

3.4 Backup Responsibility

You are solely responsible for maintaining backups of your important data. We are not liable for any data loss, corruption, or deletion that may occur due to device malfunction, app uninstallation, user error, or factors beyond our control.

4. Acceptable Use Policy

No Illegal Content

Prohibition of storing or sharing illegal, harmful, or offensive materials.

No Hacking

Attempting to breach security or disrupt service operations is strictly forbidden.

No Spamming

The service may not be used for unsolicited mass communication or botting.

4.1 Permitted Use

NotesNest is intended for personal, non-commercial productivity purposes, organizing personal notes, tasks, reminders, and educational content.

4.2 Prohibited Activities

You agree NOT to use NotesNest to violate laws, infringe rights of others, store harmful or vulgar content, upload viruses, reverse engineer the App, circumvent security, access other users' accounts, or commercially exploit the App without authorization.

4.3 Content Moderation

While we do not actively monitor user content stored locally on devices, we reserve the right to investigate reports of Terms violations and take appropriate action.

Subscription

5. Premium Features & Payments

Some aspects of the Service are provided for a fee or other charge. If you elect to use paid features, you agree to the pricing and payment terms, as we may update them from time to time.

5.1 Free Version

NotesNest is currently offered free of charge with all core features available to all users.

5.2 Future Premium Features

We may introduce premium features in the future that require payment. Current free features will remain free, and premium features will be processed through Google Play billing.

5.3 Intellectual Property Rights

NotesNest and all related technology, software, designs, logos, trademarks, and code are owned by Thogoruchesti Hemanth. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal productivity purposes.

5.4 Google Play Policies

Your use of NotesNest downloaded from Google Play Store is also subject to Google Play Terms of Service, Google Play Developer Distribution Agreement, and Android SDK License Agreement.

6. Liability Limits & Disclaimers

Our liability is limited to the maximum extent permitted by law. NotesNest is provided on an "as-is" basis without any warranties.

What We Disclaim

The Service is provided "as is" and "as available". We do not guarantee uninterrupted or error-free operations.

Limitation of Liability

We are not liable for any indirect, incidental, or consequential damages, including loss of profits, data, or use.

6.1 "As-Is" Disclaimer

NotesNest is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or that the App will be uninterrupted or error-free.

6.2 Limitation of Liability

To the maximum extent permitted by law, Thogoruchesti Hemanth and NotesNest shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or use.

6.3 Indemnification

You agree to indemnify and hold harmless Thogoruchesti Hemanth and NotesNest from any claims, damages, liabilities, losses, costs, or fees arising from your use of the App, your violation of these Terms, or your content.

7. Privacy Policy

Your privacy is of utmost importance. Our collection and use of personal data are governed by our Privacy Policy.

8. Termination

Both you and NotesNest reserve the right to terminate account access at any time under specific terms.

Termination by You

You can delete your account at any time via App settings or Deletion page. Your data will be wiped within 30 days.

Termination by Us

We reserve the right to suspend or close accounts violating these Terms, engaging in illegal activities, or after 3+ years of inactivity.

8.1 Termination by You

You may terminate your use of NotesNest at any time by deleting your account through the App settings, uninstalling the App, or contacting us.

8.2 Termination by Us

We reserve the right to suspend or terminate your access to NotesNest immediately, without prior notice, for violation of these Terms, suspected illegal activity, or extended inactivity (3+ years).

9. Governing Law & Contact

These Terms are governed by Indian law, and any disputes will be handled through designated jurisdictions.

Jurisdiction

Any disputes will be resolved exclusively under the jurisdiction of the courts located in Haryana, India.

9.1 Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the courts located in Haryana, India.

9.3 Miscellaneous Provisions

These Terms constitute the entire agreement regarding NotesNest. If any provision is found invalid, the remaining provisions continue in effect. Our failure to enforce any right is not a waiver.
